Gasta Terms and Conditions

Welcome to Gasta, a service marketplace mobile application (“App”) operated by Agasta LTD (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Gasta App and its services. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

1. Acceptance of Terms

By downloading, installing, or using Gasta, you confirm that you are at least 18 years old (or the legal age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

Gasta is a marketplace platform that connects service partners (“Providers”) with users seeking services (“Customers”). Services may include, but are not limited to, home repairs, cleaning, plumbing, and other professional or personal services. Gasta acts solely as an intermediary and does not provide the services listed on the platform.

3. User Accounts

Registration: To access features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

Account Termination: We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for any violation of these Terms.

4. Service Listings and Bookings

Providers: Providers are responsible for the accuracy, quality, and legality of the services they offer. Providers must comply with all applicable laws and regulations.

Customers: Customers are responsible for providing accurate information when booking services and for paying the agreed-upon fees.

Transactions: Gasta does not facilitate any transactions between Providers and Customers. Any disputes regarding services must be resolved directly between the Provider and Customer.

5. Subscription Charges for Providers

Subscription Fees: Providers are required to pay a subscription charge to access and use the Gasta platform. Subscription fees are billed on a recurring basis (e.g., monthly or annually) as selected by the Provider.

Payment Processing: Subscription payments are processed through a third-party payment gateway. By subscribing, Providers agree to the terms and conditions of the payment processor.

Cancellation: Providers may cancel their subscription at any time, but no refunds will be issued for partial subscription periods.

Changes to Subscription Fees: Gasta reserves the right to modify subscription fees at any time. Providers will be notified of any changes in advance.

6. User Conduct

You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Harass, abuse, or harm other users.
  • Post false, misleading, or defamatory content.
  • Interfere with the operation of the App or its servers.
  • Violate any applicable laws or regulations.

7. Intellectual Property

Ownership: All content, trademarks, logos, and software associated with Gasta are the property of Agasta LTD or its licensors and are protected by intellectual property laws.

License: We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Privacy

Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you agree to the terms of the Privacy Policy.

9. Limitation of Liability

To the fullest extent permitted by law, Gasta and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App, including but not limited to loss of profits, data, or business opportunities.

10. Indemnification

You agree to indemnify and hold harmless Gasta, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the App or violation of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective upon posting the revised Terms on the App. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising under these Terms shall be resolved exclusively in the courts of Ireland.
